We hereby provide you, as a user of Swyx Mobile & Desktop applications (hereinafter referred to as “App” or “Swyx App”), with the below information concerning the collection of personal data during the use of these Apps. Personal data includes all data that relates to you personally, such as a name, address, e-mail addresses or user behavior.
In accordance with Article 4(7) EU General Data Protection Regulation (GDPR), the controller of data within the App is Swyx Solutions GmbH (see above). You can contact our Data Protection Officer at datenschutz@swyx.com or via our mailing address, for the attention of “Data protection”. Please note that a Swyx App will not work properly without an appropriate server. For its operation it is required that data from the Swyx App is synchronized with the corresponding servers. Therefore, the processing of data by the server is the responsibility of the operator of the server. More Information can be found in the chapter “Functions of our Apps”.
If you contact us by e-mail or via a contact form, we will save your e-mail address and, if provided, your name and telephone number in order to answer your queries. We will erase data collected in this context after storage is no longer necessary or – in the case of statutory retention obligations – we will restrict processing.
In your dealings with us, you have the following rights concerning your personal data:

The functions of our Apps can only be used in conjunction with a server, for which you, your company or your employer have purchased and installed a licensed version of the Swyx software. App functions will only be available after authentication and synchronization of the data with the corresponding servers.
BWhen downloading the App, required information is transferred to the respective marketplace, in particular user name, e-mail address and customer number of your account, time of download, payment information and the individual device ID. We have no influence on the collection of this data and are not responsible for it. We only process the data to the extent necessary for downloading the App to your device and for using the App resp. the usage of Swyx Messenger. Depending on the App, it may also be possible to download it directly to your device free of charge via our website. Additional data is processed via the website during a download. Information about this processing is included in the Privacy Policy for our website: https://www.swyx.com/data-privacy.html.
The personal data described below is collected when using the App. This data is required for technical purposes to increase ease of use for App functions and to ensure stability and security:
Swyx Messenger
Additionally to the data which is collected due to the general usage of the App, the following data is collected when using Swyx Messenger (Menu item “Chat”):
The data collected due to the usage of Swyx Messenger is transferred on the basis of a data processing agreement to the server of our partner company Voiceworks B.V. (Part of the Enreach Group). The transmission of the data is encrypted for transport via https. Voiceworks B.V. is only allowed to process the data for the mentioned purposes.
The data is first collected in the App and then synchronized with the corresponding server on which the corresponding Swyx server software is installed to the extent necessary to provide the relevant functions. Only you have access to data stored solely in the App. The corresponding operator of the Swyx software has access to the data located on the server. (Legal basis is Article 6(1)(b) GDPR.)
In addition, as a user you have the option to generate an error report in order to request specific support in the event of an error. This report contains personal data and can be sent by e-mail to any e-mail address on request. Please note that, depending on the technology used by the e-mail provider, your data may not be secure during e-mail transmission. Furthermore, we create a non-personalized, permanent unique identifier which is stored on the server to uniquely identify an App for technical reasons.
When you start using our Apps, we ask for your permission to use your address book, photos and media. We will not use this data if you do not give permission. In this case you may not be able to use all functions of our App. You can subsequently grant or revoke permission at any time using the settings in the App or operating system.
If you permit access to this data, the App will only access your data and synchronize it with the server on which the associated software is installed to the extent necessary to provide the relevant functions. Only you have access to data stored solely in the App. The corresponding operator of the Swyx software has access to the data located on the server. (Legal basis is Article 6(1)(b) GDPR.)
Uninstalling the App permanently deletes all data in the App. We have no influence over, and are not responsible for, the length of time for which data is stored on the servers.
Subject to appropriate consent, the Swyx App uses HockeyApp to collect anonymous usage data to determine usage-related statistical indicators that we can use to improve our website and make it more attractive for you as a user. The data is anonymized from the outset at the time of collection and cannot be associated with a specific person at any time. You may revoke your consent to the collection of this data at any time in the “Settings” menu. Third-party information: https://hockeyapp.net/
Swyx Solutions GmbH has no access to the personal data contained within the Swyx App. In the Swyx App you can view, correct or erase data or revoke consent for data processing. Data can be exported from the server by the respective Swyx server operator for purposes of transferring data. As a general rule, the relevant server operator is responsible for data from the App that is synchronized with the servers. Within the scope of normal operations, this data is located concurrently in both the Swyx App and on the servers.
Generated error reports, which you can optionally activate and send by e-mail, are stored in a local file directory on your mobile device. Please delete this data as soon as it is no longer necessary for error analysis.
Swyx Apps use SSL encryption for the data and audio connection to the server. These are therefore not accessible by third parties.
